GENERAL TERMS AND CONDITIONS OF SALE AND USE OF THE WEBSITE

We are Anidra International KFT (“Company”, “we”, “us”, “our”), a company registered in Hungary at Honvéd u. 8-1 em 2 ajto, 1054 Hungary, Budapest, Hungary 1054. Our VAT number is HU32500781.

We operate the website https://www.drydeenatural.com (the “Site”), as well as any other related products and services that reference or link to these General Terms and Conditions (“the Conditions” or “Terms”).

We supply solid cosmetic products for body care entirely made in Italy.

These General Terms and Conditions govern our relationship with you, whether you are a business user or a consumer user (“you”), and concern the use of our site and all sales transactions between Anidra International KFT and you.

By accessing our site, you agree to use it in accordance with the following Terms.

Any additional terms and conditions found elsewhere on our site are expressly incorporated herein. We reserve the right, at our sole discretion, to make changes or modifications to these Terms and Conditions. We will notify you of any such changes by revising the "Last Updated" date. You agree to periodically review these Terms and Conditions to stay informed of any updates.

Our Services are intended for users who are at least 18 years old.

Persons under 18 may not use or register on the Site.

1. OUR SERVICES

The copyright, license and trademark rights on the contents of this Site – texts, photos, images, designs, logos – are exercised by Anidra International KFT.

All rights reserved.

We comply with the Consumer Code and European Directives on the protection of consumer rights; in accordance with which we have designed this Site.

All information on the characteristics of the products sold and their prices (total, as well as net, VAT and any shipping costs) are available in the dedicated sections.

We strive to display the colors, features, and details of our products as accurately as possible. However, we cannot guarantee the accuracy and reliability of the displays, as your display may not accurately reflect the actual colors and details of our products.

All products are subject to availability and cannot be guaranteed to be in stock. We reserve the right to discontinue any product at any time and for any reason.

2. PAYMENT AND DELIVERY METHODS

Our site offers simple and secure payment systems.

Our users can pay via:

• Apple Pay
• Credit and debit cards (Visa - Mastercard - American Express)

Business users who require an invoice must request it in the notes section when ordering; it will not be possible to issue one after shipment.

All payments will be made in euros, including shipping costs and VAT applicable at the time of ordering.

We reserve the right to correct any errors and to update the pricing information at any time.

We reserve the right to refuse any order placed through our Site.

We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These limits may include orders placed by or under the same customer account, the same payment method, and/or orders that use the same billing or shipping address. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.

Products will be shipped within 3 days of payment verification.

Please take into account that

• After payment, it will no longer be possible to change the shipping address.

Tracking is not available.

In the event of delays, damage, and/or loss of the product during transport, we ask you to write to us at help@drydeenatural.com or in the "Customer Area" section so that we can verify the reasons for the delay with our suppliers and, if necessary, provide you with a refund.

3. Legal guarantee of conformity

Transactions with our consumer users are guaranteed pursuant to Articles 128-135 of the Consumer Code, as amended by the legislator in 2022, in the event of defects of conformity. Please note that to benefit from the guarantee, the defects must exist at the time of delivery and become apparent within 24 months of the purchase date (it is the user's responsibility to provide proof of purchase).

The lack of conformity must be reported within 2 months of the date of discovery of the defect. Unless proven otherwise, it is presumed that any lack of conformity that becomes apparent within 12 months of purchase of the goods already existed on that date.

The Legal Guarantee does not apply to orders placed with an invoice and VAT number by business users.

A "lack of conformity" occurs when the purchased product has objective or subjective defects of conformity. If the consumer wishes to claim the warranty for lack of conformity, he or she is responsible for proving the date of purchase and returning the product deemed defective to: Via Pavia 23 - 20814 VAREDO (MB)

We reserve the right to examine the product and verify whether for any reason the Legal Guarantee cannot be applied (e.g. more than two years have passed since the date of purchase, the product shows damage and/or anomalies that were caused by the consumer and do not result from a lack of conformity).

If we do not find the alleged defect, the shipping costs will be borne by the user. However, if we do find a defect, our Customer Service will contact the user within a reasonable timeframe and inform them of possible remedies.

4. RETURNS

If you are not completely satisfied with the products you have chosen, you can return them within 14 days of receipt.

We will be happy to offer you an exchange or, if you wish, a refund, as long as the products are returned intact, in perfect condition, unused, unopened, and in their original packaging.

Shipping costs for returning products are the responsibility of the user.

If we are asked to replace the product as a result of an error not attributable to us, we will apply our standard shipping rates to the new shipment.

For hygiene and health reasons, we cannot accept returns of products that show even minimal signs of opening or use.

If you notice an error during the order process, if the shipment has not yet been dispatched, you can contact us and we will do our best to remedy the situation where possible.

5. YOUR USE OF OUR SITE

You are authorized to access all sections of the site and, if you wish, may download or print a copy of any portion of the content therein. This use is solely for personal, non-commercial use and is in compliance with all trademarks and copyrights owned and/or authorized by us. You may not access or use our site for purposes other than those for which it was made available (e.g., in connection with commercial initiatives, except those specifically endorsed or approved by us).

No content from this site may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose without our express written permission. User contributions.

 

By sending us questions, comments, suggestions, ideas, feedback, or other information about our products ("Submissions"), you agree to assign to us all intellectual property rights in such Submissions, and we reserve the right to use and disseminate them unrestricted for any lawful purpose, commercial or otherwise, without acknowledgment or compensation to you. If you agree to chat, contribute, or participate in blogs, message boards, online forums, and other features where you may create, submit, post, display, transmit, publish, distribute, or broadcast content and materials to us ("Submissions"; including, but not limited to, text, writing, video, audio, photographs, music, graphics, comments, reviews, ratings, personal information, or other material), you acknowledge that such Submissions may be viewed by other users.

For each User Contribution, we are granted an unrestricted, irrevocable, non-exclusive, royalty-free, worldwide license (including the use of your name, trademarks, or logos appearing in the User Contribution) to: use, copy, reproduce, distribute, publish, transmit, retitle, archive, publicly display, reformat, translate, excerpt (in whole or in part), and exploit the User Contributions for any lawful purpose, commercial, advertising, or otherwise, including preparing derivative works of, or incorporating into other works, the User Contributions, and sublicense the licenses granted in this section.

This license includes our use of your name, company name, and franchise name, as applicable, and any trademarks, service marks, trade names, logos, and personal and commercial images provided by you.

Self-responsibility.

 

You are solely responsible for what you post or upload and will be solely responsible if you post, submit, upload, or transmit through our site any Submissions that are unlawful, harassing, hateful, harmful, defamatory, obscene, bullying, abusive, discriminatory, and/or threatening to any person or group, sexually explicit, false, inaccurate, deceptive, or misleading.

Furthermore, it assumes exclusive responsibility in the event of content that infringes rights, licenses and confidential information.

Removal of Content.

While we have no obligation to monitor Contributions, we reserve the right, in our sole discretion, to remove any Contributions we deem to violate these obligations, to suspend or disable your account, and to seek legal action.

Intellectual property of others.

We respect the intellectual property rights of others.

6. USER STATEMENTS

You represent and warrant that:

• all registration information provided by you is true, accurate, current and complete;
• will promptly update such registration information as necessary;
• has the legal capacity and agrees to comply with these Terms;

• do not access the Services through automated or non-human means, whether through bots, scripts or otherwise;
• You agree not to use our site for any illegal or unauthorized purpose.

If we determine that you have provided us with any information that is untrue, inaccurate, not current, or incomplete, we reserve the right to suspend or terminate your account and refuse any and all current or future use of the Services (or any portion thereof).

7. USER REGISTRATION

You are/are not required to register to use our Services.

You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we deem, in our sole discretion, that username to be inappropriate, obscene, or otherwise objectionable.

8. REVIEW GUIDELINES

Users who decide to post a review agree to comply with the following guidelines:

• must have direct experience with the person/entity being reviewed, avoiding false or misleading statements;
• must avoid profanity or offensive, racist or hateful language;
• must avoid discriminatory references based on religion, race, gender, national origin, age, marital status, sexual orientation, or disability;
• must avoid references to illegal activities;
• If you post negative reviews, you must not be a competitor or affiliate of theirs;
• You may not organize a campaign that encourages others to post reviews, whether positive or negative.

We reserve the right to accept, reject, or remove reviews at our sole discretion. We have no obligation to moderate, monitor, or remove reviews, even if someone deems them objectionable or inaccurate. Reviews are not endorsed by us and do not necessarily represent our opinions or those of our affiliates or partners. We assume no responsibility for reviews or for any claims, liabilities, or losses arising from reviews.

By posting a review, you grant us a perpetual, non-exclusive, worldwide, royalty-free, fully paid, assignable, and sublicensable right and license to reproduce, modify, translate, transmit by any means, display, perform, and/or distribute all content relating to the review.

You agree that we will not be liable in any way for any loss, damage, or inconvenience caused by your inability to access or use the Services during any downtime or interruption of the Services, except for compliance with applicable privacy obligations.

12. APPLICABLE LAW. JURISDICTION AND DISPUTES

These Terms and Conditions have been drawn up and must be interpreted in accordance with Italian law, and recourse to the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.

If your habitual residence is within the European Union and you are a consumer, you also enjoy the protection provided by the mandatory provisions of the law of your country of residence.

If you are a business user, you agree to submit any disputes arising from violations of these General Terms and Conditions to the exclusive jurisdiction of the Court of Rome.

If you are a consumer user, in order to avoid and expedite the resolution of any dispute, controversy, or complaint in any way related to the application or interpretation of these General Terms and Conditions, you undertake to engage in informal negotiations and initiate a mediation procedure - including electronically - before taking legal action.

13. ELECTRONIC COMMUNICATIONS, TRANSACTIONS AND SIGNATURES

You consent to receive electronic communications and agree that all agreements, notices, disclosures, and other communications we provide to you electronically, via email and on our site, satisfy any legal requirement that such communications be in writing.
You expressly agree that these Terms and Conditions are entered into exclusively in electronic form.

14. MISCELLANEOUS

These Terms and our policies posted on the site generally govern the relationship between you and us. Our failure to exercise or enforce any right or provision of these Terms will not constitute a waiver of such right or provision.

These Terms operate to the maximum extent permitted by law.

We reserve the right to assign all or part of our rights and obligations to third parties at any time. We cannot be held responsible for any loss, damage, delay, or omission not attributable to us.

If any provision or part thereof contained in these Terms is held to be unlawful, void or unenforceable, its deletion shall not affect or prejudice the full validity, enforceability and legality of the remaining provisions.

No joint venture, partnership, employment, or agency relationship exists between you and us as a result of your compliance with these Terms or use of our Services.
